What is Restored Information?

Federal agencies across the United States have been removing information that once was readily available to its employees and to members of the public, especially information as it relates to the LGBTQ+ community.

  • We are providing here the original version of Enforcement Guidance on Harassment in the Workplace which was voted upon by majority at the U.S. Equal Employment Opportunity Commission in 2024. This original guidance has since changed on the U.S. Equal Employment Opportunity Commission’s public website in 2025.

On May 20, 2025, Acting Chair Andrea Lucas issued to the public a revised version of the U.S. Equal Employment Opportunity Commission’s (EEOC’s or Commission’s) Enforcement Guidance on Harassment in the Workplace (Harassment Guidance or Guidance) that shaded out all references to harassment on the basis of sexual orientation and gender identity.  The Acting Chair was responding to a May 15, 2025, federal district court decision that Title VII does not encompass workplace harassment because of sexual orientation or gender identity, despite relevant Supreme Court precedent, and accordingly that all language in the Guidance about sexual orientation and gender identity was vacated (without specifically identifying it all).
