2025

  • On May 20, 2025, Acting Chair Andrea Lucas issued to the public a revised version of the U.S. Equal Employment Opportunity Commission’s (EEOC’s or Commission’s) Enforcement Guidance on Harassment in the Workplace (Harassment Guidance or Guidance) that shaded out all references to harassment on the basis of sexual orientation and gender identity.  The Acting Chair was responding to a May 15, 2025, federal district court decision that Title VII does not encompass workplace harassment because of sexual orientation or gender identity, despite relevant Supreme Court precedent, and accordingly that all language in the Guidance about sexual orientation and gender identity was vacated (without specifically identifying it all).

2024

  • This guidance issues the Commission’s guidance on harassment in the workplace under EEOC-enforced laws.

    Important Note: While this guidance remains on EEOC’s public website, the Acting Chair of EEOC has shaded out portions of the guidance that were inclusive of gender identity due to a Texas federal court decision that was issues on May 15, 2025.

    Additionally, the Acting Chair plans for the Guidance to be modified or even rescinded. EEOC is unable to do so until the Commission has a majority vote. Without a quorum present, this may take some time yet. We’ll keep you updated of this guidance’s status.
